Background: For more than a decade, Winston & Strawn and Nextpoint’s litigation support experts have partnered on some of the firm’s toughest cases. The Verdict: At trial, a jury ruled in favour of Winston's client, which had faced a potential liability into the hundreds of millions. Instead, Winston's team was able to secure a multi-million dollar jury award for their clients.

The Tactics: The team used dramatic presentations and crafted a compelling case regarding complicated manufacturing equipment. The combination of onsite support and use of cloud-based applications to manage evidence allowed for cost-effective trial work, with fewer team members on site.
The Technology: Nextpoint is an advanced, cloud-based evidence management system. Graphics and core presentations were hammered out in-person at a high level. Using the Nextpoint service to coordinate efforts, remote support staff from Nextpoint’s Chicago office completed the work, providing additional graphics capacity to speed up turn around time when the edits need to be done quickly. “Part of the strength of Nextpoint’s offering is that, in addition to an experienced litigation services team, the company delivers an advanced technology platform that allowed us to manage and execute a very complicated strategy,” says D’Amore. “Their cloud-based technology is powerful, secure, and cost-effective.”
Nextpoint polished opening and closing presentations, provided video editing support, and developed a series of slides that helped win the case. Illustrative graphics and overlays were created in advance of the trial as well as several new presentations which were created on the fly during the actual trial. “As in a lot of high-stakes litigation, we had to be fast, nimble, and ready to execute new tactics on a moment’s notice,” says D’Amore. “Nextpoint’s support team allowed us to execute complicated new strategies on the fly that helped make the case.”
Turning Point: During lunch recess, Winston’s team came up with a strategy to not only undermine the opposition’s expert witness, but to turn the testimony in their favor. Taking the expert’s slide deck, the team was able to grey out text and highlight a portion of the evidence that actually supported their claim. Winston’s Steve D'Amore was able to ask the witness if, in fact, his testimony supported his clients' contentions, crossing out information on the slides with a flourish, helping the jury to clearly see the opposition’s case falling apart.
