In the most recent session, Michele Kell, Project Director for the Nextpoint Client Success team explained important considerations and questions every litigator needs to know when beginning the process of collecting evidence and setting up a document review. During the event, we took question online via chat. We tried to answer as many as possible at the end of the event, but didn’t have time to get to them all. Here are answers to the remaining questions:


If a document has been scrubbed, can the original metadata ever be recovered?

Not really. The only reason a party would scrub a document is to remove metadata and similar information. This is why we recommend negotiating with opposing counsel to have native copies of all files collected. Even if metadata or related information is lost, you can recover it from the native files.


Can documents that have been encrypted and emailed be unlocked and viewed once uploaded?

If documents are encrypted and attached to emails, they won’t be able to be imaged in our application. However, if we have the password, we can apply a list of passwords onto encrypted files to open them. If you have the password and run the Nextpoint ECA process on the files prior to importing them into Review,” encrypted files can be opened.


How does Nextpoint coordinate with Relativity since it seems to be a popular platform that might be used by opposing counsel?

Nextpoint offers multiple export formats and most are compatible with Relativity.
